  6. PLEASE READ THIS LICENSE CAREFULLY BEFORE DOWNLOADING THE SOFTWARE.  BY
  7. DOWNLOADING OR USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE
  8. TERMS OF THIS LICENSE.  IF YOU DO NOT AGREE TO THE TERMS OF THIS
  9. LICENSE, YOU ARE NOT AUTHORIZED TO DOWNLOAD THIS SOFTWARE.

  12. License.  The application, demonstration, system and other software
  13. accompanying this License, whether on disk, in read only memory, or on
  14. any other media (the "Apple Software"), the related documentation and
  15. fonts are licensed to you by Apple.  You own the disk on which the
  16. Apple Software and fonts are recorded but Apple and/or Apple's
  17. Licensor(s) retain title to the Apple Software, related documentation
  18. and fonts.  This License allows you to use the Apple Software and fonts
  19. on a single computer and make one copy of the Apple Software and
  20. fonts in machine-readable form for backup purposes only.  You must
  21. reproduce on such copy the Apple copyright notice and any other
  22. proprietary legends that were on the original copy of the Apple
  23. Software and fonts.  You may also transfer all your license rights in
  24. the Apple Software and fonts, the backup copy of the Apple Software and
  25. fonts, the related documentation and a copy of this License to another
  26. party, provided the other party reads and agrees to accept the terms
  27. and conditions of this License.

  29. Restrictions. The Apple Software contains copyrighted material,
  30. trade secrets and other proprietary material and in order to protect
  31. them you may not decompile, reverse engineer, disassemble or otherwise
  32. reduce the Apple Software to a human-perceivable form.  You may not
  33. modify, network, rent, lease, loan, distribute or create derivative
  34. works based upon the Apple Software in whole or in part.  You may not
  35. electronically transmit the Apple Software from one computer to another
  36. or over a network.

  38. Termination.  This License is effective until terminated.  You may
  39. terminate this License at any time by destroying the Apple Software,
  40. related documentation and fonts and all copies thereof.  This License
  41. will terminate immediately without notice from Apple if you fail to
  42. comply with any provision of this License.  Upon termination you must
  43. destroy the Apple Software, related documentation and fonts and all
  44. copies thereof.
  45.  
  46. Export Law Assurances.  You agree and certify that neither the
  47. Apple Software nor any other technical data received from Apple, nor
  48. the direct product thereof, will be exported outside the United States
  49. except as authorized and as permitted by the laws and regulations of
  50. the United States.  If the Apple Software has been rightfully obtained
  51. by you outside of the United States, you agree that you will not
  52. re-export the Apple Software nor any other technical data received from
  53. Apple, nor the direct product thereof, except as permitted by the laws
  54. and regulations of the United States and the laws and regulations of
  55. the jurisdiction in which you obtained the Apple Software.
  56.  
  57. Government End Users.  If you are acquiring the Apple Software and
  58. fonts on behalf of any unit or agency of the United States Government,
  59. the following provisions apply.  The Government agrees: (i) if the
  60. Apple Software and fonts are supplied to the Department of Defense
  61. (DoD), the Apple Software and fonts are classified as "Commercial
  62. Computer Software" and the Government is acquiring only "restricted
  63. rights" in the Apple Software, its documentation and fonts as that term
  64. is defined in Clause 252.227-7013(c)(1) of the DFARS; and (ii) if the
  65. Apple Software and fonts are supplied to any unit or agency of the
  66. United States Government other than DoD, the Government's rights in the
  67. Apple Software, its documentation and fonts will be as defined in
  68. Clause 52.227-19(c)(2) of the FAR or, in the case of NASA, in Clause
  69. 18-52.227-86(d) of the NASA Supplement to the FAR.
  70.  
  71. Limited Warranty on Media.  Apple warrants the diskettes and/or
  72. compact disc on which the Apple Software and fonts are recorded to be
  73. free from defects in materials and workmanship under normal use for a
  74. period of ninety (90) days from the date of purchase as evidenced by a
  75. copy of the receipt.  Apple's entire liability and your exclusive
  76. remedy will be replacement of the diskettes and/or compact disc not
  77. meeting Apple's limited warranty and which is returned to Apple or an
  78. Apple authorized representative with a copy of the receipt.  Apple will
  79. have no responsibility to replace a disk/disc damaged by accident,
  80. abuse or misapplication.  ANY IMPLIED WARRANTIES ON THE DISKETTES
  81. AND/OR COMPACT DISC, INCLUDING THE IMPLIED WARRANTIES OF
  82. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN
  83. DURATION TO NINETY (90) DAYS FROM THE DATE OF DELIVERY.  THIS WARRANTY
  84. GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS
  85. WHICH VARY BY JURISDICTION.

  87. Disclaimer of Warranty on Apple Software.  You expressly
  88. acknowledge and agree that use of the Apple Software and fonts is at
  89. your sole risk.  The Apple Software, related documentation and fonts
  90. are provided "AS IS" and without warranty of any kind and Apple and
  91. Apple's Licensor(s) (for the purposes of provisions 7 and 8, Apple and
  92. Apple's Licensor(s) shall be collectively referred to as "Apple")
  93. EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT
  94. NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
  95. FOR A PARTICULAR PURPOSE.  APPLE DOES NOT WARRANT THAT THE FUNCTIONS
  96. CONTAINED IN THE APPLE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT
  97. THE OPERATION OF THE APPLE SOFTWARE WILL BE UNINTERRUPTED OR
  98. ERROR-FREE, OR THAT DEFECTS IN THE APPLE SOFTWARE AND THE FONTS WILL BE
  99. CORRECTED.  FURTHERMORE, APPLE DOES NOT WARRANT OR MAKE ANY
  100. REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE
  101. APPLE SOFTWARE AND FONTS OR RELATED DOCUMENTATION IN TERMS OF THEIR
  102. CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.  NO ORAL OR WRITTEN
  103. INFORMATION OR ADVICE GIVEN BY APPLE OR AN APPLE AUTHORIZED
  104. REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE
  105. OF THIS WARRANTY.  SHOULD THE APPLE SOFTWARE PROVE DEFECTIVE, YOU (AND
  106. NOT APPLE OR AN APPLE AUTHORIZED REPRESENTATIVE) ASSUME THE ENTIRE COST
  107. OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.  SOME JURISDICTIONS
  108. DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE
  109. EXCLUSION MAY NOT APPLY TO YOU.

  111. Limitation of Liability.  UNDER NO CIRCUMSTANCES INCLUDING
  112. NEGLIGENCE, SHALL APPLE BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR
  113. CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR INABILITY TO USE THE
  114. APPLE SOFTWARE OR RELATED DOCUMENTATION, EVEN IF APPLE OR AN APPLE
  115. AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  116. DAMAGES.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION
  117. OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE
  118. LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. In no event shall Apple's
  119. total liability to you for all damages, losses, and causes of action
  120. (whether in contract, tort (including negligence) or otherwise) exceed
  121. the amount paid by you for the Apple Software and fonts.
  122.  
  123. Controlling Law and Severability.  This License shall be governed
  124. by and construed in accordance with the laws of the United States and
  125. the State of California, as applied to agreements entered into and to
  126. be performed entirely within California between California residents. 
  127. If for any reason a court of competent jurisdiction finds any provision
  128. of this License, or portion thereof, to be unenforceable, that
  129. provision of the License shall be enforced to the maximum extent
  130. permissible so as to effect the intent of the parties, and the
  131. remainder of this License shall continue in full force and effect.
  132.  
  133. Complete Agreement.  This License constitutes the entire agreement
  134. between the parties with respect to the use of the Apple Software,
  135. related documentation and fonts, and supersedes all prior or
  136. contemporaneous understandings or agreements, written or oral,
  137. regarding such subject matter.  No amendment to or modification of this
  138. License will be binding unless in writing and signed by a duly
  139. authorized representative of Apple.
